Last October, a Ministerial Order APM 1040/2017 was published where the date from which it is already exigible to have constituted such financial guarantee for certain industrial activities is established.

On October 30, 2017, Order APM/1040/2017, of October 23, was published in the BOE, establishing the date from which the constitution of the mandatory financial guarantee will be required for the activities of Annex III of Law 26/2007, of October 23, on Environmental Liability, classified as priority level 1 and 2, by Order ARM/1783/2011, of June 22, and by which its Annex is modified.

This means that for a few companies, those carrying out activities considered as priority 1 and 2, the time has come to pay attention to this issue. Some of our customers may be affected by this regulatory change, especially those whose characteristics correspond to the following descriptions:

• Installations for the production of cast or crude steels (primary or secondary melting), including corresponding continuous casting installations with a capacity of more than 2.5 tons per hour.
• Application of molten metal protective coatings with a processing capacity of more than 2 tons of crude steel per hour.
• Ferrous metal foundries with a production capacity of more than 20 tons per day.

From October 2019, these activities being classified as priority 2, it will be mandatory the constitution of such guarantee whose amount and characteristics are to be determined in agreement with the competent administration.
